GENERAL RULES, REGULATIONS, PRIVILEGES AND NOTICES 一 般 規 定、法 規、特 權 及 通 知
1. PARTIES 當事者
World Gym and you agree that by signing this Agreement, you purchased a membership and agree to all the terms in this Agreement. You also agree to follow World Gym’s Membership Policies and any posted Club Rules. The terms “You”, “Member”, and “World Gym” include heirs, estates, agents, representatives, officers, directors, shareholders, successors, affiliates, subsidiaries and employees. As such, both parties make this Agreement on behalf of, and it binds, all these included persons and entities.
World Gym 及閣下同意簽署本合約之後，閣下即購買一份會員資格並同意本合約一切條款。閣下也同意依照World Gym的入會政策及俱樂部公告的任何規定。「閣下」，「會員」以及「World Gym」一詞包括其繼承人、資產、代理人、代表、幹部、董事、股東、繼任者、分支機構、子公司以及員工。因此，本合約由雙方代表一切包括在內的人以及實體簽定。
2. OPERATION HOURS AND FACILITIES 營業時間及設備
World Gym provides such operation hours and facilities as listed in the Member Handbook. There shall be no reduction in Facilities except for short-term maintenance (3-5 working days). World Gym is required to provide experienced and licensed trainers during operation hours to familiarize the members with Facilities. World Gym is required to provide first-aid supplies and skilled users of such supplies on the premises
World Gym提供如會員手冊所列之營業時間及健身設備，於合約有效期間內，除短期維修（3至5個工作天）外，不得減少。World Gym於營業時間內，應提供具資歷並取得證照之教練在場，並適當教導會員熟悉使用各種健身設備。World Gym應於活動場所內備有救護裝備及熟練使用之人員。
3. PHYSICAL HEALTH OF MEMBER 會員的身體健康
World Gym urges all Members to obtain a medical examination prior to the use of any exercise equipment. You represent that you are in good physical condition and have no medical reason, disability, impairment or ailment preventing you from using all World Gym facilities, or in engaging in active or passive exercises or that will be detrimental or inimical to your health, safety, comfort, or physical condition. You acknowledge that World Gym did not give you medical advice before you joined, and cannot give you any after you join, relating to your physical condition and ability to use the Facilities. If you have any health or medical concerns now or after you join, discuss them with your doctor before using the Facilities. You have the right to request that World Gym provide a physical assessment within 15 days after you join. If it is determined that you are unfit to exercise at World Gym, your membership may be terminated.
World Gym鼓勵全體會員在利用任何運動器材之前應先接受健康檢查。閣下在此聲明其自己之身體狀況良好且無任何醫療事由、疾病、失能、受傷，或機能失調，造成閣下不應使用World Gym之器材，或不應從事主動或被動性之健身運動，或閣下的健康、安全、身體之舒適感、且身體狀況亦將不會因此而受到傷害或有害健康。閣下在此確認，關於您的身體狀況及使用健身器材的能力，World Gym在您加入之前未曾給您任何醫藥方面的建議。若閣下目前或加入之後有任何健康或醫藥方面上的任何顧慮，在您使用健身器材之前請與您的醫師討論。閣下有權自費要求World Gym在您入會並繳費後十五天內安排體適能檢測，如發現不適合者，得解除契約。
4. CONDUCT OF MEMBER 會員的舉止
Member shall be subject to the control and guidance of World Gym staff and follow the instructions of the staff while in World Gym. Members agree to conduct themselves in a quiet and well-mannered fashion so as not to cause any disturbances which would interfere with the use and enjoyment of World Gym by other members and guests. Under no circumstances shall Member use foul, loud, or slanderous language, or harass, molest, badger or solicit other members, guests or staff, nor shall Member move exercise equipment about, or use the equipment in any manner not authorized by World Gym management. Member agrees to follow all club rules as posted from time to time. World Gym may impose or change these rules and regulations at its reasonable discretion. Member agrees to pay any extra charges for any damage arising from any careless or negligent use of the equipment or Facilities by Member or Member’s guest(s).
會員在World Gym時應接受World Gym員工的管制與指導，並遵照員工的指示。會員同意舉止保持安靜與應有的禮節，而且不會造成任何干擾妨礙其他會員或來賓使用World Gym的健身器材與興致。在任何情況下會員決不大聲喧嘩，惡言相向，言語粗俗，或騷擾、戲弄、或教唆其他會員、來賓或員工，未經World Gym管理階層同意，會員亦不准隨意搬動健身器材或以未經同意之方式使用設備。會員同意遵守俱樂部隨時公告的一切管理規章及規定。World Gym有權基於安全及管理之需要，為適當合理之頒佈或修改該等管理規章及規定。另請注意，如因可確定且可歸責於您或您的來賓之事由，致於使用健身器材時所造成World Gym之財物損害，您應負擔連帶損害賠償責任。
5. MEMBERSHIP CARD, LOCKER KEY 會員卡、鑰匙
The membership card is the property of World Gym and must be surrendered to World Gym at the conclusion of the membership. A NT$200 fee shall be charged to any Member who fails to surrender their membership card at the conclusion of the membership. Should the membership card become lost or stolen, a NT$200 fee shall be charged for replacement. Upon entering World Gym, Member shall register at the Front Desk and must present membership card to Front Desk personnel. The key to the locker used by the member is the property of World Gym. Member is responsible for keeping the keys. A NT$500 fee shall be charged if the key is lost or stolen.
會員卡是World Gym財產，因此在結束會籍時應交還World Gym。結束會籍時未交還會員卡的會員必須繳交$200元。萬一會員卡遺失或失竊，應繳交$200元補發，一旦進入World Gym，會員須在櫃檯登記並向櫃檯人員出示會員卡。置物櫃鑰匙是World Gym財產，會員應妥善保管，如有遺失或失竊，應繳交$500元工本費。
6. HOLD HARMLESS AGREEMENT –WAIVER OF LIABILITY 免於傷害--棄權聲明
The Member understands that the activities offered by World Gym are physical in nature and can result in injury. The Member must use the fitness equipment correctly and properly according to the instructions. The Member assumes the risk of any and all injury or harm which is not caused by actions or reasons attributable to World Gym. The Member also understands that the lockers provided by World Gym are not for deposit of valuables but instead for placement of changed clothes, and therefore items of value should not be placed in the lockers. The Member should avoid bringing valuables to World Gym and if so, should carry the items at their side when working out. If the Member must bring valuables to World Gym, the items must be registered at the front desk, including their amount and value.
會員瞭解World Gym提供的都是體能性質的活動，會員須正確且適當地依據說明使用健身器材。會員瞭解使用World Gym的健身器材，不管是你自己或他人造成的，身體都有受到傷害的危險，會員應瞭解並接受承擔這種風險。會員應瞭解World Gym之置物櫃並非保險箱，其功能僅在提供會員更換及置放衣物使用，不應用做存放財物之用途，會員於World Gym活動時應避免攜帶貴重物品，否則應自行隨身攜帶並妥善保管。若會員不得已需攜帶貴重物品至World Gym時，應事先將財物交付World Gym櫃檯保管，並應填載書面申請表格，敘明財物之種類及數額。
7. MINORS 未成年
The minimum age for membership is 15 years of age. In the case of membership application by a minor, the approval or acknowledgment of the minor's legal guardian is required.
會員年齡最低限制是15歲。未成年人申請入會，應得其法定代理人允許或承認。
8. CANCELLATION–TERMINATION 解約-終止
World Gym may terminate this Agreement for the following:
(a) If Member fails to pay within 10 days of notice any overdue payment or arrangement providing for deferred payments of the enrollment fee, monthly maintenance fee, installment payments or annual dues, or (b) if Member breaches any provision of this Agreement or any of the rules, regulations and procedures promulgated or the use of World Gym or its Facilities, and fails to
improve after being corrected. (c) If World Gym terminates the Agreement under the circumstance that the Member failed to honestly report his/her physical condition on the application form or the health record, and his/her physical condition makes the Member unsuitable to join World Gym, the Member retains no right to ask for any refund.
No refunds are available upon termination by World Gym.Within 7 days after enrolling, if the Member has not yet used the World Gym facility, the Member may request that the Agreement be rescinded and ask for a refund.
Cancellation Policy:
Non-Fixed Term Membership: The Member understands and agrees that this is a no-fixed-term agreement and may be cancelled at any time following the minimum number of months as stated on the front page. If the Member wishes to terminate the Agreement prior to the completion of the minimum months, a written application must be made 10 days prior to the next billing date, and filed together with a NT$4,000 early cancellation fee and payment of any outstanding dues or fees owed to World Gym. The Membership Card and any other property of World Gym must also be returned.
The cancellations application and proof (a payment receipt ) need to send by REGISTERER mail to World Gym.
若有下列事由，World Gym可終止本合約：
(a)World Gym自會員欠款日起，經過10日催繳仍未繳納者，自催告期限屆滿之翌日起，若會員未依照計劃或安排的方式按時繳交任何費用，包括但不限於欠繳入會費、每月維護管理費、分期付款或年費，或
(b)若會員違反本合約任何條文或頒布的任何規定、規章及程序使用World Gym或其健身器材經規勸仍不改善者。或
(c)入會申請書或健康記錄所載不實而其健康狀況不宜使用World Gym者。一旦World Gym終止合約，會員不得要求退費。
會員於繳納入會費後7日內，如未使用World Gym設備者，得要求解約並請求退還已繳費用。
退會政策：
不定期限合約：本人瞭解並同意本合約為不定期限合約，會員欲終止本合約者，應於下次扣款日期十(10)天前親自提出書面申請，並退還屬於World Gym 任何財產、償還應付給World Gym 之任何未清償款項。倘會員於正
面所載之『最低使用期間』內終止本合約者，並應繳交NT$4,000元之期前終止費。
退會申請書及附上之證明文件(或期前終止費發票影印本)須以掛號方式郵寄至World Gym管理部，統一審理。
9. MEMBERSHIP FREEZE
A membership may be frozen up to 2 months free of charge, subject to the following conditions:
(a) Member is out of the country. A copy of Member's passport or plane ticket or other related documents should be presented.
(b) Member is unable to exercise due to injury or disease. Proper medical documents should be presented.
(c) Pregnancy. Proper medical documents should be presented. May freeze up to 10 months.
(d) Member needs to care for a baby. Related documents should be presented. This provision only applies to children that are younger than 2 years of age.
(e) Military service. May freeze up to 14 months.
(f) Member moves due to being transferred by his/her employer, unless Member moves to a location where there is a World Gym branch.
When a membership is suspended without any of the above conditions, a one-time fee of NT$599 shall apply. Maximum freeze is two months. No refunds shall be applicable towards frozen membership time. The minimum time will be postponed during period of suspension. Members may not utilize.
World Gym facility while a membership is suspended.
The freeze application and proof (a payment receipt ) need to send by REGISTERER mail to World Gym.
有下列情況之一者，會員得向World Gym提出書面申請免費暫停會籍，最長期限為二(2)個月，最低使用期間順延：
(a) 出國，應檢附護照影本或機票影本等及其他證明文件。
(b) 因傷害或疾病不宜運動者，應檢附醫師證明文件。
(c) 懷孕者，應檢附醫師證明文件，期限最長為十(10)個月。
(d) 有育嬰之需要者，應檢附相關證明文件且限於二歲以下之幼兒。
(e) 因服兵役者，期限最長為十四(14)個月。
(f) 因職務調動而遷居，惟若會員遷居當地有World Gym分公司，則不在此限。
如非前述情形之會員暫停會員權之行使，須繳交一次申請費用NT$599，最長期限為二(2)個月，暫停期間會員權有效期間順延。會員於請假後若辦理終止會籍，請假遞延之月份不得退費或折抵其他商品。暫停期間會員不得使用本健身房的設施。
暫停申請書及附上之證明文件(或手續費發票影印本)須郵寄至World Gym管理部，統一審核。
10. AUTOMATIC CANCELLATION 契約當然終止
The Agreement shall be certainly terminated in any of the following cases:
The fitness center ceases operations, unless World Gym can provide comparable services at another location in the same city.
Member dies or loses capacity to move about.
When the agreement is terminated subject to the above conditions, World Gym will refund the membership fee in proportion to the number of days remaining in the term of the Agreement and no processing fee will be charged.
有下列情形之一者，契約當然終止：
a. World Gym 健身中心停止營業。但World Gym能提供與原合約所簽訂的俱樂部同一市區之其他處所服務，不在此限。
b. 會員死亡或喪失行為能力。
本合約依前開規定終止契約者，按契約存續期間比例退費，World Gym不收取手續費。
11. PRE-AUTHORIZED PAYMENT PLAN-BILLING INFORMATION 事先授權付款計劃-計費資料
Subject to the following conditions: 1) The items shall be drawn on or about the date or dates indicated. The transactions on your bank statement will constitute receipts for payment on your account. 2) A charge of NT$100 will be assessed to all insufficient drafts, checks or Credit Cards. 3) A late charge of NT$100 per payment is payable on any dues past ten (10) days of assigned due date.
根據下列情況：1)將於指定日期或大約指定日期憑該項目領款。貴方銀行或信用卡交易憑單即是貴方帳戶繳費收據。2)匯票、支票、銀行轉帳、或信用卡扣款若金額不足將加收新台幣100元之處理費。3)指定繳費日期經過十(10)天尚未繳費，每筆款項將加收新台幣100元的延付費。
12. ILLEGAL DRUGS AND ALCOHOL 非法藥物及酒精
Illegal drugs and alcohol are prohibited in the Facilities at World Gym. Any member caught supplying or bringing these substances on the premises will automatically lose all membership privileges without refund and will be removed from the premises.
World Gym健身房內禁止吸食非法藥物及酒精飲料。任何會員若在場內被逮獲供應或攜帶此類物品，將自動喪失會員的所有權利，且不得要求退費，並將驅出場外。
13. ASSIGN 轉讓
World Gym may assign this Agreement including all of its rights and obligations hereunder to a third party at anytime during the term of this Agreement and your consent on such assignment is not required.
World Gym得在本合約之有效期間內隨時將本合約包括本合約內之所有權利與義務轉讓予一第三人，且就該轉讓毋庸取得閣下之同意。
14. MEMBERSHIP TRANSFER 會籍轉讓
Memberships may not be sold or transferred under any circumstances. However, if Member has to assign his membership to another person due to unavoidable circumstances, member should file an application in writing to obtain World Gym's consent and proceed with the relevant procedures according to the member brochure. The assignee should pay a processing fee of NT$1500 and a card replacement fee.
會籍不可出售或轉讓，但若有不得已之事由需將會籍轉讓予第三人者，應以書面提出申請，經World Gym同意，依會員手冊辦理相關手續，受讓者並應繳交手續費用NT$1500元以及製卡費用。
15. MEMBERSHIP PROGRAM AMENDMENTS 入會辦法修正
Except as otherwise provided, World Gym at its sole discretion, reserves the right to alter or amend the terms of any or all its membership programs, including but not limited to, pricing, usage time, and special privileges. The membership programs are not retroactive without Member's consent. Your membership does not give you any rights in World Gym, its management, property, or operation except the rights provided in this agreement. World Gym can sell memberships at different rates and under different terms than yours.
惟World Gym可自行決定，保留權利，變更或修改入會辦法的任何或一切條文，包括但不限於價格，使用時間，以及特權，該入會辦法除經會員同意外，並不溯及既往。閣下的會員資格除合約約定之權利外，對World Gym、其管理階層、財產或營運沒有任何權利。World Gym可用不同於閣下的費率出售會籍及期限。
16. USAGE AT OTHER LOCATIONS 其他地點之使用
Members are entitled to only use the fitness center location stated on the front page. Usage at other World Gym Fitness Centers which are located 25 kilometers or more from the fitness center requires a World Gym Travel Pass.
會員僅可使用本合約第一頁所簽訂的健身中心，若要使用距離健身中心25公里以上之其他世界健身俱樂部，必須辦理旅遊通行卡，方可使用。
17. CONFIDENTIALITY 保密義務
World Gym shall maintain the confidentiality of the personal information of the member.
World Gym對於會員所留抵之個人資料將有保密義務。
18. FREE GIFT ITEMS 贈品約定及效果
Free gift items are a part of the membership agreement. In the event of early termination, the member shall be responsible for refunding the value of the item to World Gym.
World Gym所贈商品(不含入會商品)為簽約條件之一，若會員提早終止合約，須以該商品價格賠償World Gym損失。
19. JURISDICTION 合意管轄
The parties agree to submit disputes arising out of this agreement to the jurisdiction of the Taiwan Taichung District Court in the first instance. However, members may request that jurisdiction be the district court at the place where the membership was purchased.
因本合約所生之爭議時，除專屬管轄外，雙方同意以台灣台中地方法院為第一審管轄法院。但會員得主張由消費關係發生地之地方法院管轄。
20. OTHER ITEMS 未盡事宜
With regard to matters not provided herein, the applicable laws and regulations, customs, and the principle of good faith shall govern.
本合約如有未盡事宜，依相關法令、習慣及誠信原則公平解決之。
